Divorce in schedulled tribe

(Querist) 27 June 2017 This query is : Resolved 
I and my Ex-wife belong from scheduled tribe in Gujarat.We separated on mutual concent before 7 months by notary agreement. But now she want to come back and continue the normal marriage life. She claimed that the notary divorce is not valid but I am not ready to accept this.

So please let me know what should I do?

Notary Public has absolutely no authority to solemnise a matrimonial union and/or to terminate a valid marriage, by agreement.

Notary divorce may not be enforceable under law.

Discuss in detail with your lawyer.

If you do not want to keep her with you, no one can force you to live together.

The hon'ble High Court in your state has decided such matters.

Pls note that the custom ( of your scheduled tribe) that attained legal sanction (if any) needs to be proved with evidence (if exists).

Legally you are husband and wife, there is no value of notarised divorce.

It is better to rejoin your marital life and welcome/enjoy it.
