Divorce

(Querist) 28 July 2015 This query is : Resolved 
Respected Sir,
1. My friend Arjun file divorce case against his wife on the ground of cruelty but lower court dismisses his divorce petition on 2003.
2. He did not appeal before High Court.
3. Till date couple is living separately.
4. His wife wants to live with him but my friend did not want to make relation bitterer.
My question is
Can my friend again file divorce petition on the ground of desertion or any other ground?
Your valuable advice is necessary to save my friend from depression.

Mr.Rajkumar, expert rightly pointed out that what is the need for your post this query instead of by your friend himself.
However, your friend can file divorce petition if there are new grounds after the dismissal of the first divorce petition.

You can, if there is a fresh cause of action. However, this unlikely as they are staying separate and it is the husband who is unwilling for the reunion.

Are you a friend or foe? When the petition for divorce was dismissed by court for want of bonafide second petition for the same prayer by cooking up a new cause of action shall be treated as malafide. I am afraid to say in Indian Judiciary you wont get any idiot judge. So advise your friend not to adopt a malafide policy for illegal gain.
