Divorce

(Querist) 10 December 2016 This query is : Resolved 
My wife has filed an FIR under sec 498A, 323, 506 against me and she in FIR, lodged in Jun 16 mentioned that I sold her car. I have obtained a copy of challan through RTI, done in Aug 2016 mentioning that she was driving the same car and her signature is there on the challan. Would this evidence is sufficient to get divorce.

You seem to have forgotten that you have to fist fight the case of domestic violence. Question of divorce is a separate issue. Mere a solitary false statement about selling of car cannot be a good reason for divorce.

Save the marriage if possible.

Both parties have to shed their ego, pride and reconcile.


Save the irrefutable evidences also that shall come to rescue later, if differences are not reconciled.

Sir, I have tried all means to reconcile with her and save my marriage but she and her parents are not interested. She is in extra martial affair with a guy in her company and didn't want to go my hometown. Also the false allegations are framed on me under section 498A. I have not asked any dowry and in turn I deposited Rs 1 lacs in her ACCT. For mutual divorce they are asking Rs 40 lacs

If she is having extra marital relation engage services of some private detective, gather proof and proceed.

What sort of proof you have with you to ask for divorce?

Even if you have any strong proof in that respect the same cannot dilute the case of 498A, 323, 506. Per force, you will have to contest that. Better concentrate on that case first and after judgment think about anything else.

Problem is he is very much antagnistic of the woman; he has no humanity as such is obvious;l at all costs wants to escape punishment and worse is he wants her punished besides; but his way of approach is indeed too much indecent as he talks of her extra martial affairs. sorry, iota of humanity is needed in every one more so if the person is one's own wife.
i wonder how he dare to castigate her with 'extra marital affair' that in the court back fire him very badly.
