Disown son

(Querist) 26 May 2015 This query is : Resolved
We are family of 6 me, my wife and my son, my elder brother , his wife and our father My father is constantly forcing me to move out of the house and says he disowns me from everything name , property and doesn't want to have relation with me. I am very worried where I will take my wife and minor child with me if he move us out of the house.

He gets his monthly pension, has one ancestral and self owned house. I want to know what actions he can take against me and what should I do to save guard my family.

Please help me at earliest

Anonymous author with adopted/presumed name as "advice313gmailcom" concealing identity.
Consult a local lawyer with complete details of properties and query.

Discuss with local lawyer.Don't conceal anything.

Many times counseling by lawyer is beneficial for the client.

author has nowhere stated that it is ancestral property so there is no ground to agree or disagree with Mr Jeevan Patil.

@ author

how did you manage to annoy father to that extent.
T. Kalaiselvan, Advocate (Expert) 01 June 2015
You have a right in the ancestral property alone, better file a partition suit for seeking a share in it.
Sudhir Kumar, Advocate (Expert) 01 June 2015
I repeat

author has nowhere stated that it is ancestral property

SO I am not able to agree or disagree wit Mr Kalaiselvan.

Sudhir Kumar Sir,

The author has mentioned as under:

"He gets his monthly pension, has one ancestral and self owned house"

let him clarify whether the house in ancestral for him or his father as well.

I Thank all the experts who have commented above and want to clarify few things:

1. Hiding identity is just for the purpose so that family name is saved and nothing more than that.

2. About the property to clarify it was Grandfathers property and there was no will, so all sons of my grandfather including my father divided property among their names. I am not sure will it still be called ancestral property or self owned.

3. I tried to talked to my father several times and tried to resolve issues but he still sticks to his decision.

4. He is still a Father to me and just to protect my family(wife ,child) if such situations occurs I wanted advice from experts like you what actions he can take and what should I don in that case.

you can sue your father for partition.
