Departmental inquiry

I am working in charitable hospital for the last 20 years and after completing my trial and probation period I was taken as regular employee. This hospital comes under the purview of Labour Law. My query is that I have reported certain facts regarding embezzlement of funds which were misused by senior officials to higher authority and after due investigations the amount was also recovered back, but by the passage of time I was on & off harassed by these senior officials due to which my health deteriorated by tense mind. I personally made requests to meet the Head of society but was not allow to meet and finally full details in writing through registered mail were mailed to Head of Society by my real brother. Now after a period of 6 months the senior officials have made an inquiry to submit my reply with 3 days. In the inquiry letter they have levelled charges against me that I have reported official matter to outsider through my brother. I personally feel that my services can be terminated and I survive with my house-wife and small children's. My appeal is that kindly reply urgently to my query that what remedy can be taken. Whether I should approach the civil court or High Court or Labour Court.

It is reiterated that you should reply to all points, pointwise and you may have a remedy.


The employer may not have a right to transfer even if it has extracted an undertaking from employees and even courts may not concur with right to transfer.



If you have already shown all documents on record to an able Labor law Consultant/Service Matters Lawyer/Law Firm and have given inputs in person and have answered the pointed and specific questions of your counsel and after that if your counsel has opined that employer can not transfer the employee then your counsel may be right.



If you want us to help you and give proper opinion then you must answer all points raised in this thread.
