Delay in possession of flat by builder

Hi All.
Pl guide me,i booked a flat with a builder in 2012.i paid around rs 2.5 lakh plus loan from bank of rs 17 lakhs.
Bank paid rs 13 lakhs to the builder but builder stopped the work and now is absconding.
What to do now ?

File consumer complaint against the builder.

Lodge FIR for cheating etc. against the builder.

If the builder absconding than firstly you should lodge FIR against him for cheating and misappropriation of funds with the Police, let them investigate and try to trace him and find his whereabouts. The complaint with the district consumer forum will require serving him the notice first which in his absence will return unserved and moving to district consumer forum where notice sent to him will also return unserved won't serve your purpose. You should try to trace him and find his whereabouts with help of local detective than only your purpose will serve.

Mr. Sikarwar In fact there is no particular legislation to help you.in such a situation. The real estate sector is mist unregulated sector of india. Even the newly passed RERA act does not provide remedy to your problem.It does not contemplates of the situation where the builder abscond with the money deposited by the allotees leaving the project incomplete. You may be hearing the woes of flat buyers in J P Infratech all the courts and the government are finding it difficult to help them.They have a ray of hope as some new promoters are now interesed in this project.So Mr Sikarwar if you really interested in finding a solution first gather as many allotees as you can then file FIR in a group,try to attrect media attention toward the project. Secondly find out if the buildeer has taken any loan for this project from any bank for this project peruse the bank to take recovery action and sell the project to some new builder.If fight alone it is difficult to get early result.

Lodge FIR followed by a Consumer complaint, through a local lawyer, as soon as possible
