(Querist) 30 July 2014 This query is : Resolved
Dear sirs
I am living in Guwahati and my relative who is living in Noida, without informing me, gave my reference number while taking any personal loan or credit card loan.
Now,my relative became defaulter, being a referee I have been repeatedly getting calls from debt collection agency. I am personally feel like being trap in debt.
My relative who's got the same number while he took the loan, is not picking up the phone.
Debt collection Agency asked me the address, which i don't know.

Please tell me what to do with the situation?

Thanks You

You are neither borrower, nor co borrower, nor guarantor hence not liable for anything.

Each bank has to maintain list of recovery agencies on its website. You can find out the address.

Record all such calls/meetings(audio/visual) and state whatever you want and tell them to write to borrower and stop calling you at once or you shall be constrained to lodge police/criminal complaint, and include the MD/CEO of the bank, local BM, BM and proprietor of agency amongst list of noticees.

If they do not mend their ways lodge police complaint under proper acknowledgment and approach your lawyer to issue legal notice.

you have nothing to fear . you have not borrowed any funds nor given any guarantee . let the bank catch hold of defaulter
Sudhir Kumar, Advocate (Expert) 30 July 2014
you have nowhere stated that you were guatantor. As observed by Mr Kumar Doab and Mr Sethi bank cannot sue you.

However if you are guarantor then you can be sued by bank. Please check once again.

You have stated that you were made reference without information to you. now it raised question:-

(i) when you came to know of such reference.
(ii) what did you do to drop or honour this reference.
(iii) did you receive a call on this reference.
(iv)for what the recovery agency is seeking your help
(v) any threat you received from them
