Husband has filed divorce petition on bases of cruelty. Both children aged around 16 years supporting him. if he will get divorce on the ground of cruelty from wife in that case also he has to pay maitenance to wife? plz reply me.

Proving cruelty against wife is very difficult in the court of law.It is easy to prove it against the husband than against the wife.UR saying that the children are staying with him, will they testify against their mother, I see a bleak chance.Come out with the total facts for a better advice.

maintenance depends on so many factors, case file need to be referred.

Agreed with expert Mr.Sainath. But cruelty and maintenance are separate factors and not to be connected. As regards payment of maintenance, it depends upon many factors.
