You will not be going to be benefitted from the court due to your unemployment. Only the credit card company can help in postponing the recovery.

Under which section the recovery suit case come?
Kumar Doab (Expert) 04 March 2015
You may go thru Card issuance form,T&C,Cardmember agreement.

The banks usually prefer to approach LokAdalat..

The bank may sell the debt to recovery agencies................and the agencies shall chase.....

It shall certainly be better to negotiate with bank and pay.

The settlement shall be an adverse entry.................and affects credibility in future.

If the bank has already initiated its action approach your lawyer with all communications on record.

Your query, "Under which section the recovery suit case come" in the position of a defaulter reveals as if it is not your personal problem, rather you are seeking answer to your law school question.

Anyway, don't worry about section, if you are defaulter, the bank and their lawyer will take care of the relevant section when case is filed against you.
