Court fee for fixed-deposit receipts

(Querist) 21 November 2014 This query is : Resolved
DEAR SIR,
My mother met with an accidental death on 2nd November 2014 without a will.
Now her fixed deposit amount of approximately 36 lacs is lying in bank of maharashtra without a nominee.
Bank is asking for succession certificate.
I want to know the court fees in this case. Is there any upper limit for fees?

Regards,
Prasanjit

RBI has issued guidelines to release payment of deposit of deceased account holders without production of succession certificate. If the Branch is not cooprating, write to higher authorities for releasing the payment. It need one affidavit, Indemnity bond / letter, and other minor formalities.

However, stamp fee is local subject consult to local lawyer. However, it would be much costlier than the above suggested method which would hardly cost 2-3 thousand.
