Converyance of property

(Querist) 29 November 2015 This query is : Resolved
In our society two members have not registered their flat and only paid stamp duty, however the society has issued them share certificate. Now the builder is objecting to the same that conveyance of the property cannot be done by him since two members have not registered their flat. Is it compulsory that the registration of all flats is must for conveyance.

The query is short on material facts.

1. UN-Registered Agreements have no legal value.

2. Registration is a documentary proof of Title-Ownership.

As per TPA 1872, sale of all properties of over Rs 100=00 have to be Registered. It is in the interest of the purchaser to Register the sale agreement to have a clear undisputed title to the property

If stamp duty has been paid, get the property registered in the name of owners.

Sir,
I would like to know whether the stand taken by builder for refusal of conveyance to the society is correct because due to two members entire society is suffering
