Consumer fourm bench clerk.

Dear sirs and madams:

What is the role of the bench clerk in a consumer forum?

As per my understanding it is calling out case number, party names and announcing date given by the president.

Other than that making entry into confonet is another job of the bench clerk.
Taking the files back to cupboard in the office. Taking the files from the cupoboard in the office to the court hall.

Is the bench clerk a counsellor appointed by the consumer forum? What authority has the bench clerk to do counselliing of the complainants and give advice to them?

What can be done to stop this.

Can RTI be of any help?

Unless you indicate what sort of counselling (which you think it was conselling) was given by him, it is not possible to comment.

The said employee shall perform duties assigned by his/her authority...

The tips and suggestions by him/her may not necessarily be bad,.
Some consumers, even counsels take help of forum staff..

Do you think we will be asking the basics like what is the 'Court' and what is the Bench, and what is a clerk?
If you thought that none of us ever worked in Court or did not even know what a bench clerk is, you ought not to have posed this query here at all!
If you think that you are the most intelligent and smart, better keep the same to yourself.

No Bench Clerk is entitled to do any Counselling.

Many times these Bench Clerks speaks to Advocates and Clients in a friendly manner in Courts and used to share their opinions. Advocates also need their help and used to be friendly with them.

Any misbehavior or undue advantages of such Bench Clerks could be complained in open court to the concerned Judge or Magistrate or Presiding Officer Or else a Written Complaint could be filed with concerned Registrar.
