Consumer court related

(Querist) 27 September 2016 This query is : Resolved
I Have won a case against a builder in APril 16 and the judgement is as below

"the builder has to pay me within 30 days from the date of receipt of this order"

The builder is absconding and not taking the order. Anyway out to this?

All the experts suggested me to file execution petition u/s 25 & u/s 27 and get the attachment of builder properties

But i don't have the his property's list and it is difficult to find out. Anyway out in this situation.

No use to repeat a similar query especially when earlier stands attended.

Yes, not a good habit to repeat.

BUT even then many authors go on repeating for the reasons best known to them.

Raj Kumar sir,

I have no other intention to repeat the query. The solution described by you, i have discussed with my advocate and requested him to move the petition but he says he needs the list of property's of that builder so that he can get the attachment from the court but my problem is i cannot get the list and it is very difficult to get also. If i cannot get the property's list, can't the execution petition be moved in the court? if can't be moved then what is the next solution available to me? Request you to kindly suggest.
Rajendra K Goyal (Expert) 08 November 2016
In absence of such list, execution would be difficult.

Ask around and you may succeed.
