Consumer court case

Respected sir I was a candidate for sbi po pre exam 2016 for which I had paid an examination fees of rs.600 to ibps. During the 1 hour exam conducted in an engineering college in nagpur my exam session expired for 3 times in an hour due to which I was disturbed and could for give the exam up to the mark. I was also made to sit on another system after that. All this happened during that 1 hour time due to whixh I lost my concentration and was disturbed. Consequently I failed in the pre exam and hence I would not be able to appear for the mains. Please guide me in this regard weather I should file a complaint in the district consumer court and seek adequate compensation. Also please guide me on how to determine the compensation for mental agony caused to me and opportunity lost. I also intimated ibps, the organisation which conducts the exam in this regard but it was of no use. Please guide me in this regard.

If the exam was held per procedure / schedule, no case of mental agony lies.

Respected sir, the examination fees was paid by me and hence dont he concerned authorities have the responsibility to provide for an environment without any technical failure. As I mentioned before it was a preliminary exam of 1 hour duration in which one has to solve 100 questions in 60 minutes. Hence concentration and alertness is of utmost importance which I lost due to 3 consequtive technical failures/issues. I informed the same to the centre manager and he directed me to TCS control room who manage the technicql issues. All they told me is to lodge a complaint on grievance redressal link on their web site. Can I file a complaint regarding loss of opportunity due to such technical issues as I wont be able to appear in sbi mains exam now and hence lost an opportunity for which I had prepared for several months and which I lost due to technical issues.

U need to prepare again for same preliminary examination If u are really brilliant other wise think of going for consumer case.

Would it be fit to file the case. What are my chances to get a compensation. If yes what amount should I demand from them.

Mr. Sreekumar,

I don't see any chance for you to get any compensation for your hypothetical proble and academic problem.

However, if there is any truth in your query, first of all you may clarify, what do you want to convey by your statement, "my exam session expired for 3 times in an hour"? In what way your exam session could epire three times within an hour.

Secondly, as per your profile, when you are already working as a District Manager of some organization, how would you like to justify your candidature for much lower post of a probationary officer of a bank?

Thirdly, if falsely shown as a District Manager, instead of a student in your profile, was their any specific reason to mislead the members here through your wrong profile?

Dear Mr. Dhingra I was working as the district manager of government sponsored epri project when I joined this group. I started preparing for the exams this year itself. I do not intend to mislead anybody as it would not benifit me in any way. I hardly know anybody in this group. As far as my problem is concerned all the competitive exams are conducted on computers which are connected to a server room. Due to some reason it may so happen that the ongoing exam session for a candidate may encounter technical failure. One need to contact the engineer stationed at the examination centre to again restart it. This problem is very common and I am not the first person to raise it. By the term SESSION EXPIRED I mean sudden stopping of your exam with the computer screen showing the message SESSION EXPIRED PLEASE RESTART. This happened to me 3 times during that 1 hour exam. The exam is online exam and due to some technical failure in the server room it hapoens so. I am a member to a lot of groups catering to various purposes and so never thought of fooling or misleading anybody. I never thought that people have so much time to look into my profile made about 1 1/2 years ago.

Dear Sreekumar,

You have not touched my 2nd query about your preferment for the lower post of a PO, being already on a higher position.

Anyway, I don't feel any chance to be there for any compensation, unless you produce any solid proof about technical snag in server, but not in your own computer or not being the time consideration for expiry of the sessions. You would like to think, 100 questions in one hour means about 36 seconds on an average per question for posting solution. Of course there may be some upper limit of about a minute or so for posting solution to one question. Naturally, technical snag of the server, not your own machine, would be quite essential to be proved, if you want to file case for compensation. If you have that readily available that is fine.

I resigned from that post due to personal reasons. I am preparing for government exams as of now. Thank you very much for your advice.

I dont think that my personal life and my current occupation should be of somebodies interest, just because I am a member of this group. This group is for a different purpose, I suppose. The situation was not for you only. Some of the candidates must have been succeeded in such situation. Your claim for compensation has negligible merits.
