Consumer complaint

In case of consumenr complaint against pvt. Ltd. co., to whom to make party whether it is company or directors or both. Further if any director who was director in the company at the time of default, but later on resigned, whether he can also be made a party.

Sir,
All the directors and the Company have to be made party to the Consumer Complaint. The Director, who subsequently resigned, but was a Director at the time of default has also to be included.

Private Limited Company is a legal entity. It is enough if such a Pvt. Ltd. Company is made a party.

Dear Author ,For Example in Banks if there is a Defaulter of Loan the Particular Manager who had sanctioned the Loan would continue in the Legal Recovery Procedure even if he had Retired.In your case even if it is a Private Ltd Company Obviously only its Directors would be Responsible.

Let us not dispute on others comments, we shall ignore it even if we come to know that the answer given by any particular expert is not correct or proper. In my opinion to, the company as a whole will be held liable and not the individual directors, more particularly the former director. A case filed against the company will be duly represented by the company, if they object to it as a company then there are chances to implead the director was responsible for the cause of action for the case.
