Collecting biometric data for wallet startup

(Querist) 13 October 2015 This query is : Resolved
Hello,

We are working on a semi closed wallet with fingerprint authentication.

What are the rules in India regarding enrolling, storing and usage of finger prints by the sole acceptance of the user interested in our services.

We highly appreciate any information related to this.

Regards

search google.

Prima facie, the proposed business interferes into the privacy of the citizens and hence not permissible unless duly authorised by law.

Thanks for the reply. I have done my research using google and found mixed information about the rules.

Hence, I'm looking for suggestions form experts with knowledge in Indian Laws related to bio-metrics.

The user is at their free will to opt using our services and their data will solely be used for the purposes of the app. would it still be invasion of privacy?

Thanks

Go through the I.T.Act 2000.

Thanks. Will take a look in to that.

Would we need permission from court of law before taking the app public and enrolling users?

Thanks

Court of law is not the competent authority to grant you such permissions. The competent authority will be the concerned department of state or central government under whose control such issues fall.
In the same google you can have search of the controlling and competent authority to grant such licence or permit, because as rightly observed by one of the experts above, it may be treated as invasion of privacy which may be contrary to the fundamental rights or constitutional right of the citizen of the country.
Discuss with a local consultant at length and then decide further course of action in this regard.
