Co-operative hsg society bye law

Respected Lawyers,

I am a resident of Bhayandar . I am staying in a flat which is in my mothers name.And i am the nominee.Can i be a committee member or liable for any post (chariman/secretary/treasurer ).
What can be done if i wanted to be in the post.Can i take a power of attorney from my mother or have to Gift Deed the flat on my name.
Pls advice.

Society is made of its members. Nominee is not a member unless your mother's membership gets transferred to you. Even gift deed may not work. Gift can transfer property, but not membership of the society unless membership is transferred.

So forget any position in the society, as a nominee.

1. You may ask your Mother (& consequently the Society) to make you a "associate member", subsequent to which you can become eligible for Chairman /Secretary /Treasurer /Whatsoever.

2. HOWEVER, you will need to give a proper name to yourself with proper name-identity.
