Claim for education expenses for his son from ex husband

I am a divorcee having 16yrs old son under my custody .I am not remarried. Though lower court has ordered a monthly maintenance of Rs.10,000, and arrears amount of maintenance to be paid from the year 2005 ,my ex husband has filed in higher court and got a stay on the judgement (in 2012,case is still pending) . The high court has ordered a interim maintenance of Rs.6000 for both me & my son.
As my son is in 11th std now... I am in urgent need of money for his higher education of my son can I file a fresh petition asking for Education need.? If yes, Which court should I file.

In view of the interim maintenance fixed by court for both of you and your son, no other claim can be made without the express order of the competent court.

Yes. agreed with advise of Mr.Dhingra Sir.once interim maintenance is granted, a further claim shall be granted by the competent court.
