Cheque bounce case

(Querist) 09 February 2016 This query is : Resolved
Dear sir/madam,

We had received 3 cheques from a fruad builder upon cancellation of the booking of flat, all of which bounced back.

we have approached court for this and they are simply giving dates. Its already been a year now and the court has not yet issued summons to the opposite party.

How long would this case take so that we can get our money back.

awaiting reply

sincerely

It appears that the lawyer you have engaged is less than professional. It may be that the trial could be prolonged, but summons are invariably issued immediately on taking cognisance of the offence.

In a case u/s 138 N I Act the magiistrate use to take cognizance of offence in first or second hearing itself, check with your lawyer and change if you are dissatisfied with his/her performance.

Court proceedings are time and cost consuming, it may take 3-5 years for decision.
