Cheating

RESPECTED SIR /MADAM,
I have purchased a mobile phone HTC desire V Worth Rs.13000 (through debit card) at Reliance Digital stores , Hyderabad when I visited on occasion of my cousin’s marriage on Feb 9 2014 .I reside at Vijayawada .
After passage of 3 months’ time suddenly one day my mobile phone got crashed. I have visited the HTC service center at Vijayawada for service with original bill of my mobile phone .I got the job no . registered with service center .Two days after I got a call from the service center employee saying that ,sir we are sorry to say this mobile phone’s IMEI number got registered with us long back in 2012 so we are sorry the warranty is not prevailing and returned me the mobile to me .
I have contacted the Reliance Digital Hyderabad through a call and explained everything. At first they denied about the fact that the phone sold to me is a second hand phone, but later with the proof with me they admitted the fact agreed that there was mistake. Their response was poor, it took 10 days to communicate the issue to concerned person .Finally he asked me to visit the store once, so that we validate the service warranty .I have a strong proof (old bill of the previous sale) that the phone is a second hand piece. I asked the store personal to replace it with a new piece .He said I don’t have a authority to replace the piece sir better I consult the higher officials and will inform you .Again he responded only when I have call him myself after a week. I have sent lot of mails to the head office of Reliance Digital (MUMBAI). The head office initiated the HYDERABAD branch people to solve the issue, even then the store people bargained for a lesser amount and outdated model pieces instead of offering a range of 13000 they are offered less valued handsets.
They asked me to visit their store so that they can provide me better remedy, as they said I visited the store and handed over the mobile and original bill, after proper check they repeated to say the same thing ‘’ sir we are not authorized to provide you a higher priced phone, even if its Rs.1000 more than the you have pay the balance amount got vexed with all these and I have taken back my handset and original bill.

To recover my amount with interest and damages??
Can I sue them as a consumer????
Or should I file a police report for cheating????

Devajyoti sir thank u..my query is i have purchased the phone at Hyderabad ,but i reside at vijayawada ,with a belief that i have service center at vijayawada oo so if any problem exist in future i can solve it from here itself ...so can i file a complaint at vijayawada (krishna district ) consumer forum instead of (Ranga reddy district hyd forum ? please suggest me sir ..here i have met 3 lawyers everyone is saying a different remedy ..confused
