Change of name of a member in co-op, hsg, soc.

(Querist) 03 October 2015 This query is : Resolved
Dear Sir,

There is no mention of procedure in the Maharashtra Co-op Soc. Act/Bye laws for endorsement of share certificate when a member changes his name by publishing in a official gazette.

Do the society have to obtain a membership application from the member who has changed his name and then endorse the share certificate?

Please clarify.

Regards,

V. Vaidyanathan

Such name changes are never carried out in various certificates and public documents.
Rajendra K Goyal (Expert) 04 October 2015
Though it is not necessary, however society may take indemnity from the person and one other member, affidavit, original share certificate, application and proceed after approval from AGM.
Dr J C Vashista (Expert) 04 October 2015
The changed name of member can be endorsed in all society records on an application, affidavit, indemnity bond by the member along with copy of gazzette where it has been published.
T. Kalaiselvan, Advocate (Expert) 10 October 2015
Well advised by experts particularly by experts Mr. Rajendra K Goyal and Dr. Vashista, nothing more to add.
