Change of name

(Querist) 27 January 2015 This query is : Resolved
the name of my clients had been changed by her father when she was at the age of 11 years.thereafter, her father expired without giving her any evidence of adopted legal procedure for change of her name. she continued her education with her changed name in her onward educational certificates. she had done master degree in English and also enrolled as an phd candidate.
now, she is selected for a government job. in her employment verification roll she has to provide her whole educational background starting from class one to the master degree with proof of changes if any.
now she is in legal problem in relation to her change of name made during her childhood. she has no evidence,as there is inconsistency in her present name and her past name carried up to class six.
what is the legal remedy?

Nobody will ask the educational details from class with name against each class, as generally, the name will be same except in cases like the one which you are referring. You are not giving full facts. If the details sought are only class, year, school etc., she can as well fill in the correct details. You are thinking something else and asking the query without giving full details.

Rightly analysed and observed by expert Mr. Malipeddi Jaggarao, I agree with him, it is a vague query.

Full form (required to be completed) has to be referred, consult local lawyer.

at the very outset i want to say that my present problem is a real one.

actually, i want to know that she has no documentary evidence in relation to the legal procedure followed while her name was changed in class VI by her father,as she was not aware of the technicalities of law at that stage of her life. now, she has to submit before the verification authority a verification form. in that form in 1st column it is written that" candidate name in full in block letters (mention the change of name or dropping of any part of name, if done at any stage of life)"
now, if she writes that her name was changed at class VI,then she will has to produce documentary evidence which presently she has not. OR if she omits then that will be a suppression of facts. above all, the school in which she studied from class v to class VIII, has ceased to exit long before. because that school was not a government school but a self financed one.
now suggest me a way out of it.

No Government official has the authority to pester an Indian citizen. It is sufficient if certificates of qualifications from matriculation onward is produced.
T. Kalaiselvan, Advocate (Expert) 29 January 2015
You are creating a fictitious tale saying that the authorities insist on the name from class I onwards. The matriculation certificate and subsequent academic certificates having the same name, this will establish her name and there is no need to give the details of the pet names called at home.
malipeddi jaggarao (Expert) 30 January 2015
I fully agree with final comments of expert Shri Kalaiselvan. You are entertaining hypothetical problems in your mind and prolonging the query. Write one name only with other particulars since class I. Verification will be from Matriculation/SSC only. Nobody will practically go and verify the records from class I, unless there is a complaint that the representation is wrong. In this case representation is not as the person is one and same. Do not trouble the trouble until the trouble troubles you!
