Can societies object on giving flats to bachelors

(Querist) 27 June 2016 This query is : Resolved 
I wants to give my residential flat in Mumbai on rental to bachelors/spinsters as they are more into demand of flats compared to availability of families taking flats on rentals, but Co-operative Society of the Building objected that they have passed a resolution that Flat cannot be given to Bachelors, and If i try to do so society will not issue NOC and Tenant will not be allowed to shift in.

Kindly suggest what should I do kindly educate me on the cited subject

So far I understand it is my fundamental right and my own decision as of what to do with my property and no un-regulated law brought up by any society can hold me back, whereas I am willing to give a written undertaking to society that occupants staying in my flat are my responsibility and liability.

Does society need to take a written approval from Dy.Registrar of Co-operative Housing Societies for any such adopted resolution passed in their AGM, OR Societies are fully empowered to impose such resolutions passed by committee members.

Depends on society bye laws .

The Bye Laws adopted by society are to be in accordance with Bye Laws in the state.


The bye laws framed by the society are to be sent to the registrar.

See the byelaws of the concerned society and resolutions leading to amendment there to.
