Hi sir,

My name is swarna, my father has written a will on my grand father property. Now my father expired. As per the registered will whole properties belongs to my brother sons.

I want to challenge that registered will. Please let me know, will I get share in that property.

Regards,

why do you think that will is changeable.

Please be clear, with what specific reason or plea you want to challenge the will?
Kishor Mehta (Expert) 29 January 2017
Madam,
If you have legal evidence to disprove the validity of the Will, then you can very well challenge the Will.
Good luck,
Kishor Mehta

The property that devolved from your grandfather to your father might be of self acquired nature.

The owner can dispose his self acquired property by a valid WILL in his life time, in anyone’s favor.

The WILL is registered as per your post and may not be set aside on the counts of authenticity.

What are valid grounds and reasons on which you want to contest the WILL?
Adv. Yogen Kakade (Expert) 29 January 2017
If the property mentioned in the will of your father was not his self earned property and as you mentioned that the said property was and ancestral property, then the will in this case can be challenged even if it is registered.

will is registered, if the property falls under the definition of self acquired property, you have little chances of succeeds.

if the property is ancestral, you have share in the property.
