Querist : Anonymous (Querist) 01 May 2018 This query is : Resolved
Hi All,

I'm a citizen of Norway and I had transaction and paid to a Mumbai based service provider whose services I used for commercial purpose. That person did not provide services on time despite full payment.

1. My question is, how can I engage an Indian Lawyer without coming to India? The formalities pls
2. Can an Indian Lawyer send Legal Notice if I sign n send it by post or scanned mail?

Vijay Raj Mahajan (Expert) 01 May 2018
You can very well engaged Indian lawyers through email and giving general power of attorney for doing all legal processes including sending legal notice on your behalf against the particular party. The General Power of Attorney can be duly attested by the Notary and bear Apostile Stamp from your Government. The legal notice in India as I send is both by postal mail as well email to the party against whom I'm engaged by my client in India as well from foreign country.

I agree with Vijay Raj Mahajan.

If the transaction (commercial) occurred online, then perhaps the Terms and Conditions of the transaction copy might be available with you.
Yes, you may do well to hire a Lawyer from India to send the Legal Notice. The question regarding Jurisdiction "In Personam" and "In Rem", as well as the Pecuniary Jurisdiction, might best be answered by the respective Legal Counsel.
