Build of fourth floor

(Querist) 23 July 2014 This query is : Resolved 
I have a top floor in Delhi(Third floor)with roof rights,now Fourth floor construction has been allowed.

But the owner of Second floor and first floor are not allowing me to construct, they say that originally the construction has been done for three floors only, the building may collapse etc

Please advice me that which can receive NOC from court

You have alreday purchased the roof rights hence the objection of owners of 1st or 2nd floor has no legal bearing hence obtain stay order against them from the civil court.

You first have to obtain plan approval from the competent authorities so that your the authorities do not take steps to demolish the same on the basis of not obtaining permission and other factors, thus once you obtain permission on our name based on the documents in which your have been conferred rights for roof, you may file a caveat against the people who object your proposal, then proceed with the construction, let them file a suit, you can always challenge them because you are safe and have merits in your side. Take the advise of your lawyer before proceeding.
