Bore well

(Querist) 28 July 2015 This query is : Resolved
Hi Everyone,

One of my client wants to put the bore well for 6.5 inchs, whereas, the government has stopped the same. The MRO (Mandal Revenue Officer) is given permission up to 4.5 inches and 500 feets. But in my client land 4.5 inches with 500 feet, there is no water according to Geographical and land report. Now what i can do, can i file a writ in high court. Please suggest. My client will be great loss, if he does not get 6.5 inches bore well permission. He has kept his 30 years of income in that land. My dear seniors please suggest.

First your client should apply to MRO for revision of the orders. Use RTI to find out whether any orders with specification mentioned by you were issued previously by them or not. On written refusal / no answer from the department your client should exhaust departmental avenues first by writing to higher authorities.

Respected Sir,

I thank you so much for your reply.

Sir, I did that, he got strict orders from the collector, not to give 6.5 inches permission. I have that order copy too. For revision of the orders, he said, he is not authorized to revise that order. He himself suggest to file writ.

The availability of water has no relation to the specifications for the bore well other than its depth and location.
Sudhir Kumar, Advocate (Expert) 29 July 2015
Use RTI.

Ask for Gazette notification of the rule under which the borewell has been stopped by the BDO.

The reply may be surpirsing.
