Bonus calculation (urgent)

(Querist) 23 May 2018 This query is : Resolved
Dear Sir/Madam,
I was working with a Partners ship firm of leading business group, from 18.7.17 to 21.3.18 with starting salary of 20000 and revised salary 25000 from the Nov 2017. There is nothing provided in the appointment letter about the BONUS. The important fact is that while we are calculating the TDS on salary We are taking 8.33% of last year pay as bonus for each and every employee, and that calculated bonus has been claimed as the salary expenses in the profit and losses. Then please tell me Am I eligible for bonus? And now a question is pending, how we will deal with the increased salary from Nov 2017 from 20000 to 25000. my total salary Rs 142070 after ESIC deduction for the above period, It is a very polite request to please help me to arrived at the final figure of the bonus to be placed before the past employers.

Dear Sir/Madam,

It not a same query but I am waiting for you reply on 2 question as follows.
1. Please tell me Am I eligible for bonus? because my past employer is not interested to release my bonus.
2. how we will deal with the increased salary from Nov 2017 from 20000 to 25000. because I have put the FINAL figure of bonus to employer, otherwise as per employer I will only get Rs. 7000 as a minimum bonus only.

Please guide me.

Your query is quite a vague one. You have frequently used the term "WE." like "WE are calculating TDS". Question arises, who are WE, are you employer, a single employee, or a multi entity of employees? You have also not mentioned in what capacity you were working with the partnership firm and how many workers in all were there in the partnership firm.

Still further, you have not mentioned, whether only you have not been paid bonus or all other colleagues of your colleagues have also not received bonus.
Abhay Kumar Sethia (Querist) 05 June 2018
WE stands for the employer and it indicates that how the employer is calculating the the bonus in general for all employees, and the firm not providing the bonus to all employees, who have left the firm or Removed.
secondly I was working as Executive Accountant, and this firm have more then 500 employee at present.

Is your HR department dormant or the accounts department not provided with the service laws books?

Having problem pertaining to a vast organization wit 500 employees, justification of preferring charity advice is not understood. The organization should take a regular advice from some local services laws expert. otherwise, serious problems may creep in for the management and executives for violation or non-fulfillment of the provisions of laws.

Dear Sir,
Now please tell me what should I do collect my bonus with out going to the court of law?
Kumar Doab (Expert) 08 June 2018
As posted by you; WE (Employees) left and removed ; left and removed are two different perspectives.
Employer is not interested to pay bonus and to pay only minimal bonus are also different perspectives..
Write to employer under proper acknowledgment.
Let the employer write back. IT is employer that has to declare, calculate and pay the bonus.

If you have already written to good offices of appointing authority,MD,CEO etc then expect a written reply.
Writing to employer is not like going to court.
If employer does not pay then you (and all affected employees) can write to Labor Commissioner. IT is also not like going to court.
If you can resolve with your skills between you and employer then IT is without going to court.
