Birth date correction

(Querist) 09 February 2016 This query is : Resolved
While I was going through my mother's papers after her death I found my original birth certificate issued by the Municipality of Mysore. According to this my DoB is 28/05/1959. However, DoB entered in all my records including school leaving certificate is 28/05/1958.Is there any legal way of rectifying the date in my records? Will this be accepted by my employers if corrected as I am retiring two and a half years later going by the incorrect DoB i.e 28/05/1958. Kindly advise.

Regards
Raveesha

Are you employed in Government service? It is the settled position that no request for such correction would be entertained at the fag end of service; any request in this regard needs to be made within five years of joining the service.
The position in private employment could be different.

Thanks so much Mr. Venu.

I agree with the expert opinion of Mr. P Venu.
What have you been doing since the point (DoB) came to your knowledge or concealed by your mother? There are number of instances where changed DoB is rejected by the Court, recently of General (nnow retired and an Union Minister) V K Singh's case may be referred.

Agree with the expert Dr J C Vashista.
