Bail in non-bailable case when in private complaint

(Querist) 01 August 2015 This query is : Resolved
whether a accused of non-bailable offence in private complaint can be granted bail so easily if yes any case law in this regard is available.
N.K.Assumi (Expert) 01 August 2015
There is no different provisions for Bail in private complaint or police complaint. In both the complaints Bail provisions under 167, 436,437, 438 and 439 crPc would apply in the same yard stick depending on the nature of the case.Just because the case emanate from private complaint, it does not mean that Bail can be availed easily or the Judge be soft towards the accused.

Agreed with the opinions of expert Mr. NK Assumi. The procedure is same for both, the state case or private complaint.
