Auction deposit

i participate a bid for the allotment of a shop room by the kerala irrigation department. I quote next below the toppest bidder. subsequently the toppest bidder singed and got the bid. being lost the bid i engaged for another business. now the department send letter me to take the bid as the topper was withdrawn from the bid. they warned me also that they will confiscate my deposit money if i does not take and sin the bid agreement. The tender was finalised on 20.05.2015 and i applied for refund of my deposit on15.16.2015. whether the department is right in confiscating my money or i b have a right to get back my deposit money ?
