Application under 145( 2) of ni act why necessary.

Dear sirs

Please guide as to why application under 145(2) of N.I act is necessary . i am counsel for accused in the case.
Please also help in providing the format for the same.

Frankly speaking, Your statement can be doubted without any reservation that you are a counsel for the accused. If you are really a counsel to the accused, he should better forget to defend his case. You may also have the need to rejoin the law college to learn law afresh.

You may try to get the information from the Ministry of Law through RTI. Probably that may satisfy your curiosity to know why the provision has been added in the law by the law makers or the Law Commission.

1. File simple application u/s 145(2) to court, praying that the complainant may be directed to file documents or that you wish to examine the witnesses etc....

2. The Section can used strategically as an opportunity to FORCE the complainant to produce any such documents that may exonerate the accused .or. prove that the accused is not liable.
