Hello
I got judgment from my domestic violence case Year (2013) that I need to pay 7000 Rent and 50000 one time settlement 5000 Rs Court fees. My wife is Software engineer earing 45000 Rs salary in Mumbai. She also filed case against me for Restitution in 2014 her cross is still it's going on in kalyan district court. I filled Divorce case against her in 2015 family Court mumbai. It's on hold coz of this cases is going on. I need expert advice. Thank you so much.

You need to file 1st appeal on grounds or questions of law,facts and appreciation of evidence based on which you can file 1st appeal.In appeal You can state that your wife is a software engineer and makes 45000 rupees.You can prove salary by engaging a detective agency to enquire about her salary and bring her pay slip to you so that you can produce them in court and getaway without paying a penny to her as alimony.DV case amounts you need to pay as you were guilty of domestic Violence. you need to pay as you are guilty of DV. so as a punishment DV court imposed this rent of 7000, onetime payment of 50000 rupees and Rs.5000 towards court fee. You can file your 1st appeal in Highcourt.

Mam we prove that she is working before marriage and she is getting salary in hand is 30,150/- RS , my concern is this DV judgement will help me in Restitution case. coz in various false allegation. now why she wanted to come home? i will not willing to take back her.

i married on 15/12/2010 and she left my home on 31st august 2011 it was only 9 month of period after that she sent notice to me i replied on that come home . then in 2013 she filed domestic violence case on me and started harassment me. after that she filed RESTITUTION case in 2014 after that i filled divorce case 2015 divorce case is on HOLD because of this cases. is there any way out to get out from restitution case? thanks for your prompt reply.

You just attend proceedings of Restitution of Conjugal Rights and in your reply say you are not interested in joining her for conjugal relations.It will be soon disposed of.Also say you are i9nterestedin Divorce,. If she agrees for MCD or Mutual consent Divorce file it. Maximum within 6 months you'd be issued divorce.Contested divorce you can file on the grounds of desertion and cruelty. against her.
