Appeal against acquittal

Respected sir,

As per my contention with my opponent our criminal case ( state case ) decided in JMFC in Maharashtra and acquittal judgement delivered wich total injustice with me.

Now i want to file appeal against acquittal order delivered by jmfc magistrate.

But i am confused and unable to think clearly to where to apeal ........?


Becuse one Lawyer said we have to take special leave from bombay high court to file apeal in session court.

and second lawyer said ' NO ' there is no need to take permission from high court ....session court has power to take apeal against acquittal.

Now who is right and who is wrong.

Because wrong decision lost my stand and my life

Pls guide us.

There is no inherent right of any person to appeal against any judgment or order unless a statue gives right of appeal, as appeal is a creature of the statue.You are not bound by what the lawyers said, but to look at the statue.In your case refer to section 378 crPc. please note that appeal also depends under what law accused was charged and was acquitted.
