Apartment with deviation

Hi Sir,

i am planning to buy a flat in Bannerghatta Road, Bangalore.
Currently Land is 'A' Khatha with land size 40*60[2400 SqFt]
Builder got approval from BBMP for G+3 construction and approved 1 flat per floor with 1500 SqFt.

But builder has constructed 2 flats per floor with extra 1000 SqFt.
Is it ok to buy? or its too much deviation?

Do we get alteast 'B' Khatha for this.

LIC HFL ready to provide loan also.

please suggest..

Whether occupancy certificate, completion certificate received in regard to the building?

No sir. Builder said we dont get OC and CC due to deviation.

Thanks for all the valuable information. Builder is telling if BBMP impose fine or destroy the property they will take responsibility it seems. Also builder confirmed that they will mention all these things in agreement and register. Also they are telling will repay if something happens like this and put these things in agreement.

So please advise.

No need to struck down head on big rock by purchasing such property with out OC or CC.

His oral commitment or written in agreement is of no use for you. Because u need to file case against him to get relief by paying yur time and MONEY.

Where will you go and find the builder and your own good money?


Such agreement may not be worth the piece of paper on which it is written.


Many realize it after spending money and many years in court.



If the posts in the thread are not found sufficient consult in person with your own able counsel specializing in revenue/property/civil/consumer matters.


Fee that you shall pay to your counsel shall save you from all troubles.
