(Querist) 23 August 2014 This query is : Resolved
Needed answer for mail I received from friend
Dear Sir/Madam,
My name is Praveen from Delhi ,Sir/Madam ,in Year 2001-2002 I enrolled my self for M.Com (Banking & Insurance Management), I cleared entrance examination and got admission to M.Com (Banking & Insurance Management) my application number is 153204, though while taking admission at that time I was having 10+2 certificate ,and I.T.I certificate ,before that I though taking admission to Graduation Stream ,but when I saw add in newspaper about course offered by Anna Malai University ,and after personal visit to study center located in Delhi ,I came to know the Anna Malai is running with a course of PG where basic qualification is not needed ,only person should avail the age of 21 Year’sas on dated 1.7.2001,to be eligible to apply for admission to the Postgraduate Degree courses or 18 year of age as on 1.7.201 to become eligible to apply to admission to Undergraduate/Diploma course(prospect for same is with me), so I opted for going to Post Graduate Degree. After completing my examination I was given degree in Master of Commerce Banking & Insurance Management in December 2008(My Enrollment No 103D08115900557)
Sir/Madam, on dated 22/8/2014 I visited Study Center which is run by AnnaMalai University at Delhi Branch lady in charged their have told me that now this Master Degree is invalid and this is of now is no use as Judgment passed by Honorable Supreme Court and UGC this degree is not Valid . Sir/Madam if this was such case then I think I have been cheated for same ,all my time ,efforts, money was spend was worthless ,its not case of money but it was my hard work to clear the examination ,my question here stand how can Anna Malai Unniversity help me ,now at age 40, I am no where .I was working in call center as Team Leader nor I can apply for same or other post in call center as now this degree seems to invalid ,nor I can apply to any Govt Sector ,what should I state to others for getting employment ,nor at this age I can go for any Graduation course as for any human first factor is earning bread and butter to family ,if earning gets stop how can he cope ,this is not with me it may be to other who applied to course , I am not fighting for other its about my survival . Can you help me for my query ?Or is their any supplement for me?

Does any one have answer for same ,how can person like these get judgement who can take this matter or challenge the same as it took 22 year for university to act what was wrong with this person seeking admission ,if UGC say they where unaware then it cannt be done ,we all should do something for such cases
Devajyoti Barman (Expert) 23 August 2014
iF THE PASSING OF ANY DECISION AVERSELY AFFECT ANOTHER CITIZEN, THE AME CAN NOT BE TREATED AS CHEATING.
When you took admission the degree was valid which has now in the context of SC judgement becomes illegal. In this the University is no way held responsible for cheating.
ajay sethi (Expert) 23 August 2014
agree with Mr barman
prabhakar singh (Expert) 23 August 2014
BUT I WOULD NOT BECAUSE IF THE COURSE INTRODUCED REQUIRED PRE APPROVAL OF UGC OR SOME OTHER STATUTORY BODY BUT UNIVERSITY DID NOT SEEK IT AND RUN THE COURSE THEN IT MUST BE HELD LIABLE TO STUDENTS.
Isaac Gabriel (Expert) 23 August 2014
A case is pending at the MADRAS High Court in the matter to rcognize these degrees. The Post graduate degrees obtained through open University was accepted for admission in Law colleges till the year 2008 by another judgement, and those in service on the basis of these degrees stillconducting legal battles. Several experts pleaded to approve such degrees in view of the fact that they were dispensed with after the court order. So the legislative remedy shall be the right course of action to approve these post graduation degrees. At least the UGC should compensate suitably for its fault in recognising the courses in the begining and encouraged to join .
shaila (Querist) 23 August 2014
Dear Sir, As per my finding in year 2004 admission for these courses where stopped, if university were aware of these then why it was not cascaded to student, secondly any institute or school have to ungergo certain rules and regulation n have to follow the same , why these were not followed ,though UGC and other concern body were much aware of these courses runing why at that time action was not taken against Uvinversity who where playing with student it took near about 22 Year for university after the judgement given by Supreme Court , though as per the case which were in Supreme Court civil appeal No 4173 of 2008 and Civil appeal no 4189-4191 of 2008 only then University Eye got opened .
Sir whenever a new things enter a marked positive and negative aspects are seen why Supreme Court and UGG did not though of impact it would be for number of student who have cleared these course a simple judgement passed not a valid degree , As per me no illegal thing does not happen without any person knowing UGC was aware of courses runed by university why UGC did not took any action .
Sir every government states in its manifesto right to education for every one ,then any person tying to seek education it become invalid then whats the use institute and governing body played the role of Gandhi ji 3 Monkey they kept their eye mouth ear shut to 22 long year .
Sir writing and having discussion on lawyer suit would not benefit any suffered person but really want to know is their any suit been filed so that we could help these people getting judgement

Agreed with comments of Mr. Prabhakar Singh, Mr. Isaac Gabriel....................

The affected citizens should hold the Univ. and UGC responsible.
shaila (Querist) 24 August 2014
Mr Kumar Thanks for your reply ,would like any person taking this matter again so that we can bring justice for same ,if this is not recognized that vice versa it would it effect those who are working currently on behalf of this degree,so can any one file suit again or PLI regarding same
Raj Kumar Makkad (Expert) 24 August 2014
I do agree with the experts.
T. Kalaiselvan, Advocate (Expert) 27 August 2014
Since the matter has already been taken up by some citizens in some other part of the country, matter also was discussed and decided by court, wait for the legislative remedy as rightly opined by expert Mr. Isaac Gabriel on the subject, or you may consult a local lawyer and discuss about further course of legal action and proceed accordingly.

Dear Sir/Madam,
Want to know are their cases still going on .or fresh case to be filed . As gone through many blog i am totally confused every person have different view as one blog which I read may be all have read posted by Ramachandran 4 year back ,which i am posting again for every one's kind reference ""
''Now the question If the UGC has passed an order in 1985 that an order of non recognation of PG degree awarded through Open University, why the Tmil nadu Government Passed the orders and simultaniously approved by the Governor of Tamil Nad?
As per Government of Tamil Nadu Order 216 dtd 26th Aug 1997 the Government has announced a pay rise to the teachers based on the PG degree awarded through Open University, which was signed by the then governor.
Again in order No 307 dated 16th Dec 2000 and order No 180 dated 11th Sep 2000 the Government of Tamil nadu Recognised the P.G.Degrees awarded by Annamalai University.
So, the UGC EVEN THOUGH passed an order of non recognation of open university P.G IN 1985 THE GOVERNOR, THE CHANCELLOR of the Universities, approved the P.G. IN 2000 AFTER 15 YEARS! Now, who has the power either the Governor or the U.G.C ?
Is it not a crime by the then Governor who over rulled the U.G.C. order and kept all the students,in dark , allowed the Annamalai University to swindle money from the students?
There are around 10,000 students enrolled for open university degree paid an average fee of Rs25,000 per year per student, makes 250000000 per annum multiplied by 22 years till 2007. 520,00,00,000
so 520 crores ws earned by the university after 1985 and all the IAS officers for 22 years kept their eyes, ears and mouth shut. Even the UGC didn't objected it till 2007.
So the law is only for a common man and nor a con man!
All the lawers should point out this to the Honourable Chief judge of Supeme Court and explain this.
As otherwise the lawers may also loose their degree, and the cases they appeared and won will be stayed and a fresh appeal need to be filed. ""

PG degree obtained through National Open University is now carry equal weight.
Anirudh (Expert) 29 August 2014
Dear Mr. Makkad,

The issue is regarding direct Master's Degree (without base 3 year degree course)offered by Annamalai University, which has been declared invalid by SC.

Therefore, your reply is not in sync with the issue being discussed.
Raj Kumar Makkad (Expert) 29 August 2014
I do withdraw my comments as poted above which are not based upon the issue being discussed and thanks Mr. Anirudh for correcting me.
shaila (Querist) 29 August 2014
Thanks to all for replying on tread ,but here the question still pending then whose fault was it ,do we think this question can again be put to Supreme Court ,as many have been ditched by judgement many are not coming up those who have secure job in govt or private sector are failing to come up as they are aware they would lose job but once this degree is invalid then by default person who have taken job on basis of this degree would be lose job ,instead of waiting for some vast thing to happen can this case be reopen as this is some thing cheating with candidate who have secure judgement ,court should have think about the positive and negative aspcet of ruling the judgement ,as I have the broucher with us which was pubilshed by university , if unviersity and UGC were aware why it was crub before hand why it took so long when case came to highlight in supreme court , please help the needed candaite who have completed the course and avail the degree on 2008 as per consitution on india justice should be given to all nor the candidate have enough money to battel in supreme court as money charged for such is to high can any one fight independendt for these candidate waiting for a truthful answer
Isaac Gabriel (Expert) 29 August 2014
Your concern is genuine. But no remedy is at sight, unless those who bore the brunt are taken into task.Nevertheless the calculation about the money collected is. Shocking. At least the affected could be suitably compensated on. humanitarian consideration as great disappointment was meted out. I appreciate your meticulous handling of the issue.
