Agreement validity

(Querist) 15 September 2014 This query is : Resolved
Dear Sir,
my father sold a small piece of land to a party in 1994 and it ended smoothly. then in 1999 the same party wrote on the back of the same 100 stamp paper sale agreement saying my father has received an advance for another piece from the same plot and forged my father's sign. my father denied this and the report said it was a fake sign. in 2005 they filed a suit against us for specific performances. i would like to know if a sale agreement is valid for only 3 years then why would the court take up the case?

it is necessary to go through the suit filed against your father to advice .

has your father filed any complaint of forgery against said party?

was the signature referred to hand writing expert? what is report you have mentioned?

what is the defence raised by your father in said suit?

Dear Sir,

thank you for your time.
yes, my father filed a case of forgery against them. he went to give his signature samples 3 times. at first we heard that it was indeed fake. then they changed it to inconclusive and they need more samples. my father passed away 2 years ago. the lawyer to whom my father entrusted the case was a friend of my father's friend. so he didn't really advise my father.

You can file a petition in the civil court to send the signatures to the forensic lab.

The signature samples may be from his driving license, passport, bank account etc.
