In 1958 the special powers ordinance was issued by the President of India as the N. Eastern States were affected by extensive violence by the militant groups and the states were not in a position to control. Later this ordinance was replaced by the Armed Forces (Special Powers ) Act, 1958. The preamble of the Act reads-"An Act to enable certain special powers to be conferred on the members of the Armed Forces in disturbed areas of Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Tripura and Nagaland. Subsequently it was extended to Jammu & Kashmir by that State passing similar law. By virtue of the powers vested in the Army under Sec 4 of the Act, when an area is declared as disturbed area by the State Govt, the armed forces after giving due warning fire upon or otherwise use force even to the extent of causing death against any person who is acting in contravention of law or order. They can also destroy armed dump, arrest without warrant, enter and search without warrant etc.
