Affidavit

My client has been asked to give an affidavit with two govt. employees as countersignatories. I have never heard of any such affidavit. Will experts kindly throw light on it. Thanks

Yes, you are right. I should have been more explicit. My apologies. The client has been asked to give an affidavit on a stamp paper with two govt. servants as countersignatories that he would clear the govt. dues pertaining to govt. accommodation once occupied by him once the dues are finalised and communicated to him by the concerned govt. department.

Countersign from Government employees for what purpose? If for identity or for witness may be OK, if for guarantee, sounds strange condition, whether a government employee can guarantee without departmental permission, .

I am sorry Mr. Goyal I saw your post very belatedly.You have offered a very valuable, valid point. Thanks for that. Though the client has not been told for what specific purpose the authorities require countersigning, it is nonetheless by way of a guarantee. I do agree with you that an employee would need to take prior departmental permission. But please advise me whether you have ever heard of any such affidavit. Are not authorities going overboard in asking my client to give an affidavit that law does not permit.

The matter should e referred to the higher officer of the department for this.

Is this requirement asked in writing or is it just a verbal instruction?

The client may seek information under RTI Act and obtain a copy of the relevant rule/instruction specifying the alleged requirement.
