Guest (Querist) 14 September 2010 This query is : Resolved
Advocacy is considered a noble profession, but my advocate is doing his duties quite unprofessionally, whatsoever future actions are decided between us,he goes on procrastinating,I wanna leave him but fear that on leaving, he may cheat me and leak so many things to the opponent party, which may harm my case,What is remedy in such cases, like mine???

You can report to the Bar Council of India submitting all evidences to prove professional misconduct by your counsel and seek their guidance.

Merely procrastinating the matter cannot be a sound reason for you to doubt your advocate's integrity. Do you have any other concrete and strong reason to doubt him? If you feel that he is not upto your expectations, you have the right to change. You need not hesitate.

At this premature stage you cannot complain to the Bar council against him on this ground of delay alone. It will not be entertained. If he leaks out information as you doubt, then you can approach the Bar council with concrete proof of such an ignoble act. Then only your complaint will be entertained and enquired into by the Bar Council. Use your discretion properly and fairly and act. Good luck.
