Ms.Usha Kapoor (Expert) 26 April 2017
Giving and taking of adopted child is important if both the adopted parents and Biological parents are Hindus. Boy/girl should be 15 years or less and of sound mind.Whatever rights and obligations he had from his biological parents, they will continue on adoption.

Yes, you can.

“Again her wife is pregnant . we want to adopt their excepting child.”

The child that you want to adopt is unborn.
Based on facts posted by you, your query has been addressed.

Hindu Adoption and Maintenance Act 1956

Section 10: The child must be less than 15 yrs of age. However, if a custom to the contrary exists, such an adoption may take place.

What do you mean by, "excepting child", as you stated, "we want to adopt their excepting child"?
Rajendra K Goyal (Expert) 26 April 2017
Legal adoption can only be done through Specialised Adoption agencies (SAAs) that are recognised by State Governments.

CARA (Central Adoption Resource Authority) is the Central Designated Authority of Government of India and responsible for facilitating adoption of Indian Children as per the Adoption Guidelines.
