Adoption of a step child

(Querist) 31 October 2014 This query is : Resolved
I have a query to all the experts

Mr. A is married to a lady who has a son from her ex-husband who is the biological father is deceased now.

Mr. A want the child viz the son to have his name as a father legal and wants to called himself as legal guardian. And the biological mother is ready to consent for the same.

What steps should he take to be called a natural guardian of his step child?

If the biological father is dead now then the step father can now apply on court for permission to formally adopt the child.

He can adopt the child if the conditions of adoption are fulfilled (age etc. of the child).
Sudhir Kumar, Advocate (Expert) 01 November 2014
Agreed. But the valid age of adoption is not below 18 it is below 15.

You not stated what is the religion of the husband.
M V Gupta (Expert) 01 November 2014
For adoption of the child no court permission is necessary in this case. Mother's consent is adequate, as the natural father is dead.
Sudhir Kumar, Advocate (Expert) 02 November 2014
But such consent of mother is applicable where the adoption is otherwsie valid.
