The one who was driving at thetime of accident will face criminal proceeding for rash and negligent driving and causing death by accident.

You being the owner of the vehicle is liable to compensate monetarily to the legal heirs of the deceased and also for medical expenses and others to the injured. If you have a valid insurance policy then the entire liability to pay compensation is on the insurance company.

Police may pressurize you for producing the driver. In turn driver may refuse that he was driving the car.

Consult a local lawyer and show him full case file.
