99 years lease land

Dear All,

I/we owned open land which is on 99 years lease in buldana city, maharashtra. right now we don't have any legal documents except property card.we are in planning to construct the land . is it possible to construct the appartments on this land?
pls. give your valuable advise.

what are terms and conditions of lease? you would need lessor permission to carry out construction . further you would need to have muncipal corporation permission

If you want to do any thing you have to do 2 things. First, the period of lease should be completed or the lease should be cancelled. 2. The tenant has to deliver vacation position of the premises or the tenant has no objection for the development. Then only you will proceed.

In a 99 years land, if that agreement allows to construction, you can construct building. But you have to hand over the building or vacant possession on the expiry of the lease period.

Terms of lease is most important. How can you say that you do not have any papers when the Lease-hold land is in your possession? What is the unexpired period? Query is not clear and without full facts.

If you are the owner of the land but have leased out the same for 99 years lease, only the lessee has rights over it as per the lease agreement. Please go through the lease conditions and terms if you have the agreement copy with you or else obtain a certified copy from the registrar's office, produce it before a local lawyer, take his opinion and proceed.
