No objection certificate for group a officer on contract in autonomous institute

Dear Sir,

My current designation is officer on contract (GP 7600) in an autonomous institute and this is a group-A post.
The advertisement from another autonomous institute reads as 'Those who are in REGULAR service in Government / Public Sector Establishments / Autonomous Institutions will be required to produce a No Objection Certificate, if called for interview.'

My first question is that in my case is it mandatory for me to take NOC from current employer and is it mandatorily to be produced at the time of interview; I am probably not a regular employee as my contract gets renewed after a specific period.

Secondly, Is there any rule / OM in this regard which may be applied/ cited everywhere or the requirement of taking and producing NOC would be situation specific.

Kindly enlighten with the details of the law, OM etc. if there is any.

It seems you are not required to produce NOC.

However, you should get the clear position through RTI.

The advt as posted by you, calls for NOC.

Agreed with Mr. Goyal that you can seek case specific clarification thru RTI.

Thanks a lot for your kind advice and time. But I still do not understand, when it is implicitly mentioned in the advertisement that the NOC is required ONLY for REGULAR employees, why it is required to seek info though RTI; me being on contractual job.

Also, if possible, Kindly share the basic details/ links for any policy, rule, notification, OM or law based on which the employer seeks the NOC. Is there any GOI OM or law pertinent to this exits or it is just a practice being followed without having any legal documentation by GOI/stipulated bodies.

GOI OM is not available at the moment.

You may search and wait for the posts form other experts.


You don't seem to agree that a case specific reply under RTI shall defend your interest.

RTI is to be used to get the information / clarification. If already satisfied and no need of RTI felt, you can proceed accordingly.

It is inconceivable, in my considered opinion, that a person appointed on contract basis could be a group 'A' officer.
