Registration of modt

Dear Sir,

I wish to clarify a doubt regarding MODT

i.e. My friend has taken a housing loan with his father as co applicant.But he has bought the property in chennai in his name only.
While registering the MODT with Registrar office the banker include his father name also in the MOD Document.But the registrar refuse to register the same, since the sale deed is in my friend name only.Further he asked to change the MOD with my friend name only.Whether the registrar's activity is correct?

Is there any problem with your friend, his father about not registering the document or you want to solve your own academic query, as a CA student?

Get in writing, what is the reason of refusal to register and discuss the problem with the bank for appropriate solution.

Mr.PS Dhingra if you believe like the banker have rich knowledge about the banking business or any other related activities, that is your ignorance.You have to understand one thing. i.e. Most of the Science students cleared the bank exam & got the posting.Actually that funny selection system once upon a time introduced.By those type of selection process the public suffering till now.
Further in this situation you asked like to contact banker for solution.You may think like suppose my friend will approach bank for solution & the bank will seek advice of lawyer.But there is also some problem.Because all the lawyers also not deal with all type of issues.That's why here I have raised.This is the fact.

You seemed to be confused, in yourself only, and forgot whether your query was about refusal to register by the registrar or about the knowledge of the banker. You may better reread your own query where you have asked, "whether the registrar's activity is correct? So from where the question of bankers knowledge cropped up?

Of course, you tried to play oversmart, when you are unable to reply my query, which clearly speaks, as if it is not the problem of your friend. his father, but your own academic query.

The question arises, what wrong I asked you to tell what actually was the problem that your friend or his father were facing and what wrong I advised you, if I have asked to get in writing from the registrar about the reason of his refusal to register the MODT? Evidently, you did not have any reply to that, there being no real problem. But you cleverly tried to twist the issue to evade replying my question.

Even if you have raised the question about banker's knowledge, it is not the question of knowledge of the banker what he knows or not, it is the question of the rules set by the banker's corporate office to be followed by them in completion of the loan formalities.

Even if you believe that bankers do not have the knowledge, would you be able to compell them to follow your knowledge that you would gain from this site in reply of your question, as against their loan rules & procedure? Moreover, if you believe that the bankers don't have knowledge of their banking business, why don't you sit before them and prove that they are wrong.

Moreover, you are a CA student and CAs are considered to be more knowledgeable than the bankers, you can also ask your own principal employer under whom you must be doing Articles or from your instructors of the ICAI.

In fact, yours is not a legal query, but pertains to local procedures of the bank and the registrar office, which do not deserve any reply from legal experts. You could better have posted your query at the caclubindia.

The author who is ignorant of the subject itself is calling the experts here as ignorant. What is the reply the author has for the observations and reply given by expert Mr. Dhingra? The author being a student wants to get tutored of his academic knowledge by posting such academic query in a place where experts dedicate themselves to the service of the needy and depressed litigants and actual sufferers.
A fitting reply by expert Mr. Dhingra, which I support.

Any way I have got a good reply from some experts .I have come know that your (Mr.Dhingra)knowledge level.Don't proud yourself as expert.First you should know one thing.In India most of the courses(including professional courses) are just provide basic things which will be use to the practical life of professional.Since most of the (academic) rank holders are not shine in their practical life & also some people studied in abroad.But they may be get a chance to written so many books or rules & regulation in India(Copy & paste manner) without knowledge about the practical & the situation exist in India.Further You instructed like to post in CA Club India as CA are considered most knowledgeable.Yes that is 100% Correct when compare to most of the bankers(Because science students cannot beat the commerce students in banking sector).But there is one problem will rise i.e. ego.Further I will let you one thing.Actually I have taken this matter to the some local lawyers.But I have got different opinion.That's why I have posted here to confirm.Further I never blame lawyers or any professional for their ignorance in their respective field ,Because I have never satisfied with our law makers.Because ambiguity is the domain of our law makers.So I cannot expect same opinion/correct opinion from any professional even raise the same question at most of the situations.
Any way let you (Especially Mr.Kalaiselvan) support to the law which will be very clear & really use to the society not for the law makers & also lawyers.
