Caste declaration

i am born to a hindu schedule caste father but my uncle when my parents expired has given as christian in all my school records & govt. office too since he is a converted christian. I have filed a suit in the civil court for caste declaration. what will be the consequence of the suit. will it stand by me as per recent supreme court judgment. Thanks in advance. Vennila.J.

No, either my parents nor me were converted but they used to take me to church. But I worship all gods. Only my uncles have been converted to christianity. But according to the recent supreme court judgment in the case of K.P. Manu they have declared though he was a christian. what about my case. Please clarify.

Consequence of suit cannot be judged merely by your very short description. All that depends whether you are able to establish your stand in the court of law or not. The judge of the case has to rely on the evidence adduced by the concerned parties to the case.

sir, i have produced my father's service records, school records, tc as well as my school records & tc. Now evidence is also over in the court. please clarify what is that i have to establish in the court. The Supreme Court Judge has given the judgment in case of K.P. Manu that though he is converted he has to be given the benefits of SC when he is again converted to hindu. What do you speak about this matter. thanks in advance.

You will have to wait for disposal of the case. There is no relation between SC judgement you quoting, as, according to you, neither your parents nor you converted into christianity, but it entered into the records due to the fault of your uncle. When you are not converted into Christianity where is the question of your reconversion? Wait for the judgement in your own case.

You dont keep asking the same question based on the supreme court judgement. How is that case related to your case. That is totally a different case, your case is a declaration suit based on your father's service records and other documentary evidences. You wait for the outcome of your case.

Sir, the case is in favour of me and the Judge has declared my caste as SC. Now, what should I do further after getting the decree. should I change in my school records and then in my service records since I am a State Government Servant. Pl advise me as to what steps to be taken after obtaining the decree from the court.

Submit the certified copy of Court judgement to your employer asking to enter SC category in your service records.

Sir,

Should I submit only to the employer or should I submit it to my school authorities to change it. In my judgments it is mentioned that Civil Court cannot declare the Caste of a person. Now will my case stand because it was decided in Civil Court only. Pl. advise me after submitting to the employer what steps have to be taken.
