Defects in plaint

(Querist) 26 October 2014 This query is : Resolved
Dear Sir,
One document produced with the reply of the defendant was not challenged in the plaint (rejoinder) and the judgement is given in favour of defendant based on that document stating that the validity of that document was not challenged.
Can that document be challenged in appeal?
I don't know what to do. Please help. Please.
Dr J C Vashista (Expert) 26 October 2014
After delivery of judgment in trail court no document can be read/challenged in the Court.
However, same may be brought/challenged in appeal before appellette court.
Devajyoti Barman (Expert) 26 October 2014
Yes but only if the pleading is amendned and dispute is raised in respect of the said document which is very difficult now.
ajay sethi (Expert) 26 October 2014
since plaintiff has not disputed the contents of document relied upon by the defendant court has in its wisdom relied upon said document in its judgement . chances of success in appeal are bleak
Rajendra K Goyal (Expert) 26 October 2014
full case file and judgement need to be referred, more facts required.

THE DOCUMENT PRODUCED BY DEFENDANT MUST BE VITAL.

It was proved..
You lost your opportunity .
Probably Defendant deserved it!!
Judge must have considered it , and ur adv must have no reason to challenge it??
Need full fact of case to discuss or give any opinion.

Unless the entire case and the contents of the disputed document is known, no advice will be useful to you.
T. Kalaiselvan, Advocate (Expert) 27 October 2014
As rightly observed by the experts, the plaintiff might not have found valid grounds to dispute the document brought in by the defendant to his defence but making a hue and cry now, the chances of challenging and getting a favorable outcome in the appeal is very remote.
