(Querist) 22 October 2016 This query is : Resolved 
private case was filed of 498a filed with written petition in court on which court ordered 156(3) to police and under police investigation police recorded same statement as it is as per written petition and submit the same to court with charge sheet. On this situation can I asked to court to avoid chief due to already written petition is on record of court. Without taking new chief evidence can I ask for direct cross examination on written statement.

I think you are not conversant with the instant case.If the court has passed an order to treat the complaint as an FIR u/sec.156(3) Cr.P.C. and FIR is concerned in the Police Station then you should apply an anticipatory bail in District or High Court. Charge sheet is the matter of charge of offence which may begin with the trial. Appoint a senior criminal lawyer.

i want to show already chief examination has been done at court at time of private case submission. and same petition submite dby police there is no change.

I am unable to believe that 498A private case was directly entertained by the court. I still believe that your query is purely of academic nature.
