my in laws filed a false 304b case after my wife commited suicide by hanging herself allegations in the fir are false chargesheet has been filed how can we proceed now

You are free to remarry, so go ahead. The criminal prosecution in court takes it's own time, many years to finalize and as there are numerous criminal complaints pending in all Indian courts you cannot get much relief if you seek speedy trail by fast track court.

in 304b they do not have to prove truth of allegation rather you have to prove that the allegations are false. Yes you can be convicted if you believe that they will prove allegations.

the truth is they have stated some of the incidents that never happened and there are no witnesses to support them what will be our defence and who can be defence witnesses

You are still confused

Let there be no evidence in support of allegations. It is you who have to give proof that these events never happened. They just have to utter allegations and if not able to disprove you go for minimum 7 years

They have to prove that :-
1. There was a marriage
2. Marriage was not 7 years old
3.brides died
4. She died unnatural death

So it would be presumed to be dowry death
